New York Expands Your Scope of Practice

It’s official and a win for New York licensees! As you may be aware, New York recently removed multiple services from professionals’ scope of practice, hampering the services you were able to provide. But AHP and persistent advocates like yourself worked together to bring back a service you lost. The New York Department of State issued final rules (page 12) allowing individuals performing appearance-enhancement services (limited to cosmetology) to apply silver nitrate color additives to tint eyelash or eyebrow hair.

Previously, the use of dyes of any kind on eyelash or eyebrow hair was prohibited. However, the Food and Drug Administration (FDA) now permits silver nitrate for use “in externally applied professional-use only cosmetics” if the intended purpose is to color eyebrows and/or eyelashes. The final rule requires licensed cosmetologists using silver nitrate color additives to apply the product per the manufacturer’s instructions.

Amending this rule will spur job opportunities in New York for licensed professionals in the beauty industry. Removing the prohibition and allowing professionals to safely tint eyebrow and eyelash hair using silver nitrate dye will create a new consumer market, expand scope of practice, and generate a new source of income.

AHP understands that this is only one service addition and that there is more ground to cover, but we view this as a victory and hope New York continues to return more services to your scope of practice. AHP will continue to be there to advocate for you!
